Leased vs Non-Leased Property in Karachi: Lease, Sub-Lease and What to Check

Karachi property ads lean on two words that buyers from other cities rarely see: leased and sub-leased. They matter more than almost anything else in the ad, because they tell you what kind of title the seller can actually hand over. This guide explains what each term means in practice, how the rules differ for KDA plots, flats, cooperative societies and DHA, and what to check before you pay. It is general guidance written in October 2026, not legal advice; procedures and fees change, so confirm the details for your property with a lawyer and the relevant office.

Leased, sub-leased and non-leased: the short version

Term in the adWhat it usually meansWhat you get
LeasedThe land is held on a registered lease from the authority that owns it, usually for 99 yearsA registered right you can transfer, mortgage or leave to heirs, for the rest of the lease term
Sub-leasedA registered sub-lease from the leaseholder: the builder for a flat, or the society for a society plotThe same kind of registered right, for your unit or plot
Non-leasedNo registered lease in the seller's name yet: an allotment, possession or transfer letter onlyA promise or a paper trail, not a registered title

KDA and MDA plots: the 99-year lease

Most plots in Karachi Development Authority and Malir Development Authority schemes are not owned outright. They are held on a lease from the authority, usually for 99 years, with the authority remaining the lessor. The registered lease is what makes the plot "leased", and every later sale passes that leasehold right on through a registered deed at the sub-registrar. Buyers should check how many years are left on the lease and whether ground rent and other dues are clear.

Cooperative societies add a step. According to a December 2025 letter in Dawn, the many societies under KDA and MDA have a fairly straightforward sub-lease process, while the 24 societies that belong to the Karachi Cooperative Housing Societies Union (KCHSU) follow three stages: approval by the society, then by the KCHSU, then final clearance from the federal Ministry of Housing and Works, each taking several months. If you are buying in a KCHSU society, ask the seller how far the sub-lease has progressed.

Flats: the sub-lease and the SBCA completion plan

When you buy a flat, you do not get a lease on the land. The builder (or the building's owner) holds the lease on the plot, and each flat or shop buyer receives a sub-lease of their unit. That sub-lease must be registered to give you a registered title.

Registration depends on the building being approved. Under section 18-G of the Sindh Building Control Ordinance, a sub-lease of newly built premises cannot be registered without the Sindh Building Control Authority's completion plan, and the Sindh High Court has directed that sale, lease and sub-lease deeds should not be registered unless the final building plan has been issued (reported by Dawn). In practice, a flat in a building without a completion plan can be sold to you but cannot be sub-leased in your name. That is the single most common reason a Karachi flat is described as "not leased".

  • Ask the builder for the SBCA-approved building plan and, for a finished building, the completion plan.
  • Check whether other flats in the building have already been sub-leased and registered.
  • Do not pay the final instalment until the builder confirms when your sub-lease will be executed.

DHA Karachi: Sub-Lease A, then a B or C lease

DHA Karachi uses its own sequence. An allottee or transferee of a plot first holds a Sub-Lease 'A', which works as a licence to build. Once the house is completed, the property moves to a 'B' or 'C' lease, a 99-year lease executed by the Military Estate Office (MEO). From then on the property sits under the MEO, and DHA describes transfers of these leased properties as a mutation that runs through the Cantonment Board Clifton, the MEO and finally DHA, each with its own fees and dues (see DHA's mutation procedure).

So in DHA, "leased" usually means a built property on a B or C lease, while an empty plot is on Sub-Lease A. Both are legitimate; they are simply different stages, with different transfer routes.

Non-leased property: why it is cheaper

A property is usually non-leased because the lease has not yet been issued, regularisation is pending, or the land's status is in dispute. Non-leased houses and plots sell for less, for good reasons:

  • No registered title. You may receive a transfer or possession letter instead of a registered deed, which is weaker if anyone challenges your ownership.
  • Harder to finance. Banks generally ask for registered title documents before they lend against a property.
  • Harder to resell. The next buyer faces the same questions, so the discount stays with the property.
  • Regularisation is uncertain. A promise that the lease "is coming" can take years, and it is not guaranteed.

Plots carved out of parks, amenity land or roads, often called "China cutting" in Karachi, are a separate and more serious risk: sub-leases on amenity plots have been challenged in the Sindh High Court on the ground that whoever granted them had no authority to do so. Checklist before you buy in Karachi

  1. Ask for the registered lease or sub-lease deed in the seller's name, and match the CNIC, plot or unit number and size.
  2. For a KDA or MDA plot, check the remaining lease term and that ground rent and dues are paid.
  3. For a flat, see the SBCA approved plan and the completion plan, and check that earlier buyers in the building have registered sub-leases.
  4. For a society plot, ask the society for a transfer and dues statement, and in KCHSU societies ask which stage the sub-lease is at.
  5. For DHA, ask whether the property is on Sub-Lease A or a B/C lease, and budget for the CBC, MEO and DHA mutation fees.
  6. Have a property lawyer read the documents, and complete the transfer at the sub-registrar or the relevant office, never on plain paper. Our document verification guide covers the general checks.

Frequently Asked Questions

What does "leased" mean in a Karachi property ad?

It means the plot or unit is held on a registered lease, usually a 99-year lease from the land authority (KDA, MDA, a cantonment) or a registered sub-lease from the builder or society. The lease is what gives you a registered right you can transfer, mortgage or pass on. A "non-leased" property typically has only an allotment, possession or transfer letter, without a registered lease in the seller's name.

Is it safe to buy a non-leased property in Karachi?

It carries more risk. Without a registered lease, the seller may not be able to give you a registered title, banks generally ask for registered title documents before lending, and resale is harder. Some areas are waiting for leases to be issued or regularised, which can take years. If you buy, price that risk in and have a lawyer check what the seller actually holds.

Why can't my flat's sub-lease be registered?

For newly built premises, a sub-lease generally cannot be registered until the Sindh Building Control Authority has issued the building's completion plan; the Sindh High Court and the Karachi registrar have applied this rule to sale, lease and sub-lease deeds. If the builder has not obtained the completion plan, ask why before you pay the balance.

What are Sub-Lease A and B/C leases in DHA Karachi?

In DHA Karachi the first document an allottee receives is the Sub-Lease A (licence). Once the house is built to approved plans, the property moves to a B or C lease, a 99-year lease executed by the Military Estate Office (MEO). After that, transfers of the leased property go through the Cantonment Board Clifton, the MEO and then DHA.
